Terms & Conditions

These terms govern business dealings between customers and Kunming Shanzhongyu Trading Co., Ltd. ("Mountain Whisper Tea", "we", "us"). By requesting a quotation or placing an order you accept these terms. Each order is also covered by the specific contract we sign with you.
1. Quotations & samples

Quotations are valid for the period stated in the quotation (typically 30 days) and are based on the specifications given at the time. Trial samples (20–30 g per item) are available on request and ship by express (typically 3–7 working days); international shipping is paid by the buyer. Samples reflect the production batch at the time of sampling and are for evaluation only.

2. Minimum order quantities (MOQ)

Our standard MOQ is 100 kg per item. Lower quantities can be discussed for sampling, premium ancient-tree grades and first orders. Private-label orders are subject to separately agreed MOQs and packaging requirements.

3. Grades & quality claims

We sell three grades — EU Standard, Organic and Ancient-tree Organic. EU-standard and organic grades are first-grade leaf from trees at least 76 years old; ancient-tree organic comes from trees over 100 years old. We do not supply plantation tea or young-tree tea. Organic claims (USDA Organic & China Organic) are backed by the formal organic certificates held by our certified partner facility, Yunnan Jincha (Pu'er) Industrial Co., Ltd. Quality is verified by SGS lab reports per batch, which we provide with your order.

4. Private label & packaging

Private-label and custom packaging work is agreed per order: artwork approval, packaging specifications, lead times and costs. You are responsible for ensuring your branding, claims and labelling comply with the regulations of your target market.

5. Pricing & payment

Prices are quoted in the currency stated (USD or EUR) on FOB basis. Payment is by advance T/T (telegraphic transfer) — 100% of the invoice value is paid in advance of production. Payment terms for larger or repeat orders may be agreed per contract.

6. Shipping & trade terms

All shipments are made on FOB terms. Risk transfers to the buyer once the goods are loaded on board the vessel at the port of shipment. Import duties, taxes, customs clearance and any local compliance in the destination market are the buyer's responsibility.

7. Inspection & claims

Pre-shipment inspection with retained samples is standard. Any quality claim must be raised in writing within 14 days of receipt of goods, supported by evidence. Our liability is limited to the value of the affected goods; we are not liable for indirect or consequential losses.

8. Food safety & import compliance

Goods are produced and exported under the SC licence of our certified partner facility and meet the SGS-verified pesticide residue limits stated in the batch report. Buyers importing into the EU or US remain responsible for meeting their own market's import regulations (e.g. EU border checks, FDA prior notice) at the time of shipment.

9. Website content

Information on this website is provided in good faith and may be updated. Certificates, lab reports and specifications shown are accurate at the time of publication; the documents supplied with your order are the controlling references.

10. Governing law

These terms are governed by the laws of the People's Republic of China. Disputes are subject to the exclusive jurisdiction of the courts of Kunming, Yunnan, unless otherwise agreed in the contract.
